Terms of Service
These terms govern your use of SecurePath VPN. We've written them to be as clear as we can — please read them carefully, because by using the app you agree to everything below.
01Acceptance of Terms
These Terms of Service ("Terms") form a binding agreement between you and SecurePath VPN ("SecurePath", "we", "us" or "our") governing your access to and use of the SecurePath VPN application, websites and related services (together, the "Service"). By downloading, installing, accessing or using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
02Eligibility
You must be at least 13 years old, or the minimum age required in your jurisdiction, to use the Service. By using SecurePath, you represent that you meet this requirement and that you are not barred from using the Service under the laws of any applicable jurisdiction.
03License to Use the Service
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable license to download and use the SecurePath VPN app on devices you own or control, for your own personal, non-commercial use. You may not:
- Copy, modify, distribute, sell or lease any part of the Service
- Reverse engineer, decompile or attempt to extract the source code, except where permitted by law
- Resell, sublicense or commercially exploit the Service or access to it
- Circumvent technical limits, or use the Service to build a competing product
You are responsible for the security of the devices on which you install the Service and for all activity that takes place through them.
04A Free, Ad-Supported Service
SecurePath VPN is completely free. There is no subscription, no premium tier, no paywall and no payment of any kind — every feature and server location is available to all users. The Service does not require you to create an account or sign in.
To keep the Service free, the app is supported by advertising and uses the third-party analytics and ad services described in our Privacy Policy. By using the Service you acknowledge that ads may be shown. We may add, change or remove features at any time, and we may introduce new, optional offerings in the future; if we ever do, we will update these Terms accordingly.
05Acceptable Use Policy
SecurePath is built to protect lawful privacy. You agree not to use the Service to:
- Break any applicable law, regulation or third party's rights
- Distribute malware, launch attacks, or attempt to disrupt networks or systems (including DDoS, port scanning or intrusion)
- Send spam, engage in phishing, or commit fraud
- Infringe intellectual property or distribute illegal or unauthorized content
- Transmit, store or share content that exploits or endangers minors
- Harass, threaten, defame or harm others
- Resell, sublicense or commercially redistribute access to the Service
You are solely responsible for your conduct and for complying with the laws of your jurisdiction and the terms of any service you access through the VPN. We may suspend or terminate access for violations of this policy.
06Service Availability
We work hard to keep SecurePath fast and reliable, but because it is provided free of charge we do not guarantee that the Service will be uninterrupted, error-free or available at all times. Individual servers, locations or features may be unavailable due to maintenance, capacity, network conditions or factors beyond our control. We may add, modify or remove features and server locations at any time.
07Intellectual Property
The Service, including its software, design, logos, trademarks and content, is owned by SecurePath or its licensors and is protected by intellectual-property laws. These Terms grant you no rights to our trademarks or branding. "WireGuard" is a registered trademark of Jason A. Donenfeld; other names are the property of their respective owners and are used for identification only.
08Third-Party Services & App Stores
The Service is distributed through the Google Play Store and integrates third-party components. Your use is also subject to Google Play's terms. You acknowledge that Google is not responsible for the Service and is not a party to these Terms, though it may be a third-party beneficiary entitled to enforce them. Third-party services we rely on are described in our Privacy Policy.
09Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", FREE OF CHARGE, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. While SecurePath is designed to enhance your privacy and security, no security measure is perfect, and we do not warrant that the Service will make your online activity completely anonymous or impervious to all threats.
10Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SECUREPATH AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. BECAUSE THE SERVICE IS PROVIDED FREE OF CHARGE, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED USD $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11Termination
You may stop using the Service and uninstall the app at any time. We may suspend or terminate your access if you breach these Terms, misuse the Service, or where required by law. Upon termination, the licenses granted to you end immediately. Sections that by their nature should survive — including intellectual property, disclaimers, limitation of liability and governing law — will continue to apply.
12Governing Law & Disputes
These Terms are governed by the laws applicable in our place of operation, without regard to conflict-of-laws rules. You agree that any dispute will first be addressed through good-faith informal negotiation by contacting us. Nothing in these Terms limits any mandatory consumer-protection rights you have under the laws of your country of residence.
13Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the app or by other means. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
